Disclosures In consideration of being allowed to use the golf simulator facility ("Facility") at TeeUp Golf Club, located at 12121 Northup Way, Bellevue WA, I, the undersigned participant, hereby acknowledge and agree to the following terms and conditions: Assumption of Risks: I understand and acknowledge that participating in activities at the Facility involves inherent risks, including but not limited to the risk of property damage, bodily injury, or even death. I voluntarily assume all such risks and agree that the Facility and its owners, employees, and agents shall not be liable for any injuries, damages, or losses arising out of or in connection with my use of the Facility, except to the extent caused by their gross negligence or willful misconduct. Release and Indemnification: I hereby release, discharge, and hold harmless the Facility, its owners, employees, and agents from any and all claims, actions, liabilities, demands, costs, expenses, or damages arising out of or in connection with my use of the Facility. I agree to indemnify and hold harmless the Facility, its owners, employees, and agents from any claims brought by third parties arising out of my use of the Facility. Health and Fitness: I confirm that I am in good health and physical condition and have no medical conditions that would prevent me from using the Facility. I understand that it is my responsibility to consult with a medical professional prior to participating in any physical activities at the Facility. Personal Property: I acknowledge that I am solely responsible for any personal property brought to the Facility and that the Facility and its owners, employees, and agents shall not be liable for any loss, theft, or damage to such personal property. Waiver of Liability: I hereby waive any and all claims, whether known or unknown, that I may have against the Facility, its owners, employees, and agents, arising out of or in connection with my use of the Facility. Governing Law and Jurisdiction: This liability waiver shall be governed by and construed in accordance with the laws of [Jurisdiction]. Any legal action or proceeding arising out of or in connection with this waiver shall be brought exclusively in the courts of [Jurisdiction]. Severability: If any provision of this liability waiver is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. Guest Registration: As an exclusive benefit for our valued members, you are welcome to invite guests to join you in the enjoyment of our facilities. However, we require that all guests be registered at the time of booking for any event or golfing session.
